Terms of Use

1. Acceptance of Terms

By downloading, installing, or using Reclaim ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Pedro Brun TI LTDA ("Company," "we," "us," or "our") governing your use of the Reclaim application and related services.

2. Description of Service

Reclaim is a wellness application designed to help users manage and overcome pornography addiction through:

• Content blocking features using Apple's Screen Time API
• AI-powered companion for support and guidance
• Progress tracking and analytics
• Relapse logging and trigger identification

Important: Reclaim is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. The App is intended for informational and self-help purposes only.

3. Eligibility

You must meet the minimum age requirement for your country or region to use Reclaim (typically 16-17 years old, as indicated by the App Store age rating). By using the App, you represent and warrant that you meet the minimum age requirement and have the legal capacity to enter into these Terms.

4. Account Registration

To use certain features of the App, you must create an account. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Promptly update your information if it changes
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

5. Subscription and Payment

5.1 Subscription Plans

Reclaim offers premium features through auto-renewable subscriptions:

• Monthly Subscription: Billed monthly
• Yearly Subscription: Billed annually at a discounted rate

5.2 Billing

Payment will be charged to your Apple ID account at the confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.

5.3 Cancellation

You can manage and cancel your subscription at any time through your Apple ID account settings. Cancellation will take effect at the end of the current billing period. No refunds will be provided for partial subscription periods.

5.4 Price Changes

We reserve the right to change subscription prices. Any price changes will be communicated in advance and will apply to the next billing cycle after the change.

6. User Conduct

You agree not to:

• Use the App for any illegal purpose or in violation of any laws
• Attempt to circumvent or disable the App's security features
• Reverse engineer, decompile, or disassemble the App
• Share your account credentials with others
• Use the App to harass, abuse, or harm others
• Upload malicious content or attempt to compromise our systems
• Use automated systems to access the App without permission

7. AI Companion

The AI companion feature is powered by third-party AI services (Anthropic Claude). You acknowledge that:

• AI responses are generated automatically and may not always be accurate
• The AI companion is not a substitute for professional medical, psychological, or therapeutic advice
• Your conversations with the AI are stored to provide personalized support
• In case of mental health emergencies, you should contact a qualified professional or emergency services

8. Content Blocking

The App uses Apple's Screen Time API to block adult content. You acknowledge that:

• Blocking may not be 100% effective in all circumstances
• Some legitimate content may be inadvertently blocked
• You are responsible for configuring blocking settings according to your needs
• We are not liable for any content that bypasses the blocking features

9. Intellectual Property

The App, including its design, features, content, and underlying technology, is owned by Pedro Brun TI LTDA and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

WE MAKE NO WARRANTIES REGARDING THE EFFECTIVENESS OF THE APP IN HELPING YOU OVERCOME ADDICTION. RESULTS MAY VARY, AND SUCCESS DEPENDS ON MANY FACTORS INCLUDING YOUR COMMITMENT AND CIRCUMSTANCES.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEDRO BRUN TI LTDA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Pedro Brun TI LTDA and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

13. Account Deletion

You may delete your account at any time through the App's settings. Upon deletion:

• Your account will be deactivated immediately
• Your personal data will be deleted in accordance with our Privacy Policy
• Active subscriptions will not be automatically cancelled—you must cancel through the App Store
• Some data may be retained for legal or accounting purposes

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or by email. Your continued use of the App after changes constitutes acceptance of the modified Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Brazil, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Brazil.
